Housing legal aid is available for a variety of situations, subject to the individual passing Means and Merit tests.

  • Defending Possession Claims

You may be eligible for legal aid to defend possession proceedings initiated by both private and public (e.g., local council) landlords. Legal aid may be available regardless of the grounds for possession. Our team of experienced housing lawyers can offer legal help as soon as a notice is served to tenants.

  • Unlawful Eviction

If you intend to set aside a warrant of eviction, legal aid funding may be available, subject to eligibility. Legal aid is also available to start a claim for unlawful eviction against your landlord.

  • Homelessness

Legal aid is available to assist clients with their homeless applications, subject to eligibility. Funding is available to seek review of the decision of refusal, request review of suitability/re-banding, and County Court appeals.

  • Re-Housing

If you qualify as ‘homeless’, you may be eligible for legal aid funding for your application for re-housing.

  • Disrepair

You may be eligible for legal aid to apply for very urgent injunctions for repairs, if the disrepair in your property poses a serious risk to your health and safety or that of your family.

Legal Aid is not available for any claim for damages in civil proceedings. For that, we may be able to help you on a ‘No Win, No Fee’ basis.

  • Judicial Review

Legal aid is available for housing judicial review cases, but only after Leave for JR is granted.

  • Other Cases

Legal aid is available for anti-social behaviour cases and injunctions concerning harassment in the home.
